What is this position about?
- The Head Compliance and Risk will ensure adherence to local regulations and regulatory commitments for offshoring activities, as well as adherence to BNP Paribas Compliance policies including Code of Conduct key requirements.
- He/she shall protect the Group on existing and emerging Compliance risks through active supervisory engagement and a strong risk management to ensure adherence to regulatory expectations.
- This position, based in Manila, is required to provide RISK ORM LOD2 coverage to provide operational risks for business processes and functions, performed at Manila.
- Located within the RISK Function of BNP Paribas, the role of RISK ORM Manila, is to ensure that the components of the operational risk management framework are implemented and is operating effectively.
What would be your typical day at BNPP Paribas look like?
Primary Role Responsibilities
The candidate will be responsible for handling compliance matters, ensuring good governance to comply with local regulatory and group governance. The candidate will work closely with territory management, participating in and contributing to relevant management committees and meetings.
The RISK ORM mandate is to independently challenge and supervise the operational risk management framework of the operational and Functional activities as described in the level 2 procedure – Organizational Framework and Governance for Operational Risk Management and Permanent Control Framework.
Compliance Responsibilities
- Manage and facilitate Compliance Review Committee Meeting per the Head of Territory (HoT) Charter
- Coordinate as required with various departments / functions within Manila non-banking entity to support the redistribution of responsibilities in the management of compliance risks & in coordination with Territory, APAC domains & Business Compliance teams, assist business to take over activities that shall be delegated to the 1LOD
- Implement and communicate global / regional policies / procedures adapted to local requirements.
- Perform responsibilities specific to the role of Whistle Blowing referent & Anti-bribery & Corruption Referent (refer to ABC addendum)
- Manage compliance matters and assist in the investigations related to employee cases on (professional conduct, code of conduct, conflict of interest, whistleblowing, policy regarding gifts, private mandates etc.) (refer to PE addendum) and Financial Security topics, as applicable.
- Keep abreast and have a good grasp of the regulatory landscape in the respective Territory notably developments impacting services being offered at Manila non-banking entity (e.g. increased restrictions on offshoring controls, key role on ARP (New Activity Review Process)
- Contribute and support towards setting up a risk-based Compliance framework with a view of regulatory / compliance & related risks for Manila Non-Banking entity / BNPP and potentially exposed from ‘service provider’ capacity so that outsourcing issues are effectively monitored.
- Support the industrialization of Compliance activities through global and regional initiatives on process reengineering & digitalization.
- Provide and facilitate training to management and staff on Compliance topics through induction & ongoing trainings which comply with regional & Group Compliance reporting (as required)
- Act as a Business Continuity Head, responsible for overall BCM Program of your Department to ensure business continuity requirement is integrated with all relevant processes, as applicable and their business continues when BCP is invoked. (BCM strategy, solution, documentation, Testing etc.
RISK ORM Responsibilities:
As the 2nd line of defense, as RISK ORM Manila, the following responsibilities for the operational risk processes and themes within the scope of RISK ORM including fraud, third-party, TPRM and all other pillars of Operational Risk.
- Define and consistently apply the RISK ORM methodologies and procedures (normative framework), and adapt locally as required.
- Independently challenge the identification and assessment of the operational risk profile (actual, potential and emerging) and the risk mitigation framework implemented in the operating entities, through opinions, and documentation where required.
- Ensuring effective implementation of the risk mitigation strategies, framework and actions with the 1st line of defense, through follow up of action plans and independent challenge of controls, either through execution of 2nd level controls, or where applicable, through other kinds of controls
- Independently assess and potentially alert key stakeholders on the level of risk and on the risk mitigation framework status
- Contribute to operational risk awareness and training on the risk mitigation framework.
Main Accountabilities of the Risk Role:
- Qualitative Check & Challenge of 1st line of defense mainly by the execution of 2nd LOD controls and RCSA to provide an opinion on the effectiveness of the control framework as per Group guidelines.
- Independently challenge significant incidents in Risk tool and related remediation plan.
- Proactively identify key risk areas to propose and conduct thematic reviews promptly with recommendations.
- Ensure the correct implementation and application of Group driven governance (e.g. in terms of Internal Control Committee (ICC) and operational risk management related committees, etc.)
- Promote Risk awareness and Risk culture of operational risk management across teams
- Ensure management reporting and Dashboard – either to local management or to the Group are reported on time.
- Proactive risk anticipation and raise alert on key risk topics thereby bringing in significant management attention and propose remediation.
- Stakeholder management with Department Managers / Heads locally, along with regional and Central alignment.
- Support Department Head on governance topics, Risk awareness, Reporting, global projects and awareness on guidelines to the 1st LOD within the stipulated time period.
What is required for you to succeed?
- Sound knowledge of Philippines law and regulations, technical knowledge and relevant experience in the areas referred to above and general corporate commercial matters. General knowledge of or exposure to applicable Global regulatory frameworks, market practices, and its evolutions.
- Substantial working knowledge on market integrity issues, protection of interests of clients, professional ethics and financial crime Compliance domains. Ability to partner with specialists in these areas across the region.
- Assume high levels of responsibility and possesses the ability to work independently, deal with a robust and demanding internal client base including by handling multiple matters simultaneously and meeting tight deadlines when required.
- Flexibility and ability to handle a broad spectrum of work and to establish new structures and templates.
- Ability to communicate effectively and confidently with individuals at all levels of seniority and from different cultures. Candidate must be a team player with an ability to work closely and constructively with colleagues across the region.
- Excellent working knowledge of Philippines regulations well as their practical application.
- Work experience in similar set up of activities in other global banks is a benefit.
- Minimum 5 years’ post-qualification experience gained at a leading law firm or organization, with an exposure to local regulatory framework.
